Terms of Service

These Terms of Service ("Terms") govern your use of Syschecks ("the Service"), operated by SysTeam ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Service Description
Syschecks is an infrastructure monitoring platform that provides uptime monitoring, health checks, incident management, status pages, and related services. The Service is currently in beta and is provided free of charge during this phase.
2. Beta Status & No Warranty
The Service is in active development and provided on an "as-is" and "as-available" basis. We make no warranties or representations, express or implied, regarding:
- The reliability, availability, or uptime of the Service
- The accuracy or completeness of monitoring data
- The timeliness of alerts and notifications
- The security or integrity of stored data
- Compatibility with your specific use case or infrastructure
We do not provide any Service Level Agreement (SLA). The Service may experience downtime, data loss, breaking changes, or interruptions at any time without prior notice.
3. Limitation of Liability
To the maximum extent permitted by applicable law, SysTeam and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Loss of data or data corruption
- Damages arising from missed alerts or delayed notifications
- Damages arising from service downtime or unavailability
- Damages arising from unauthorized access to your account
You acknowledge that using a free beta service for critical production monitoring is at your own risk. We strongly recommend not relying solely on this Service for business-critical monitoring without redundant alternatives in place.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorized access to the Service, other accounts, or connected systems
- Use the Service to monitor targets you do not own or have explicit authorization to monitor
- Abuse the monitoring infrastructure (excessive check frequencies, resource exhaustion, or denial-of-service patterns)
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Resell, redistribute, or sublicense access to the Service without written permission
5. Account & Data
You are responsible for maintaining the security of your account credentials. We store monitoring configuration, check results, incident history, and related operational data. During the beta phase:
- Data retention policies may change without notice
- We may reset, migrate, or restructure data as part of development
- We recommend exporting any critical data regularly using the API or report features
You may delete your account at any time. Upon deletion, we will remove your data within a reasonable timeframe.
6. Service Changes & Termination
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time, with or without notice
- Change features, pricing, or terms as the Service evolves beyond beta
- Terminate or suspend your account if you violate these Terms or engage in abusive behavior
- Introduce paid tiers in the future — existing free features may be moved to paid plans
We will make reasonable efforts to notify users of significant changes via email or in-app notifications.
7. Intellectual Property
The Service, including its design, code, and documentation, is the intellectual property of SysTeam. Your monitoring data and configuration remain yours. We claim no ownership over your data.
8. Privacy
We collect and process only the data necessary to provide the Service: account information (email, password hash), monitoring configuration, check results, and usage logs. We do not sell your data to third parties. For detailed information, see our Privacy Policy.
9. Indemnification
You agree to indemnify and hold harmless SysTeam and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Governing Law
These Terms are governed by the laws of Poland and the European Union. Any disputes shall be resolved in the courts of competent jurisdiction in Poland.
